Terms of Use

Candex provides a venue where Employers consolidate their external Suppliers and facilitate communication and transactions all over the world. To make this possible, Candex requires all Employers and Suppliers to agree to its website Terms of Use which lays out the basics of the contractual relationship between Candex, Employers and Suppliers. The following is a summary and you must agree to our full terms of use before you join Candex - so please read them carefully.

Contracting Parties:
Under the Candex Terms of Use, Employers agree that they are receiving recruitment services from Candex Solutions, Inc. (a Delaware company); and that they will be invoiced by Candex Solutions, Inc for all transactions on our website. Suppliers agree that they are acting as a sub-contractor of Candex in the performance of recruitment services and they will invoice Candex Solutions, Inc. for all placements made through the website. Suppliers also agree to be obligated directly to the Employers for any specific contract terms that are posted with each job.

Supplier Types:
There are three types of Suppliers on Candex. All transactions are automated so proper balances show immediately in each user's account to reflect the appropriate allocation of Fee per the following detail.

  • Existing Suppliers
    Existing Supplier means any Supplier who had a contractual relationship with Employer prior to the introduction of Candex. Any Existing Supplier shall be entitled to receive 97% of the Fee posted by the Employer with respect the applicable job from that Employer. Please note that Suppliers can be an Existing Supplier for multiple Employers.
  • Referred Suppliers
    Referred Supplier means any Supplier who uses the referral code of an Employer to register with the Website but who is not an Existing Supplier. Referred Suppliers will be compensated as if they were an Existing Supplier for an Employer for a period of one year from the date that their account was activated. After one year, a Referred Supplier will automatically become a Marketplace Supplier unless a previous relationship can be demonstrated.
  • Marketplace Suppliers
    Marketplace Suppliers are any Suppliers who are not Existing Suppliers or a Referred Suppliers of a particular Employer. Marketplace Suppliers shall be entitled to receive 75% of the Fee posted by the Employer with respect to the applicable job. If a Marketplace Supplier successfully makes 3 or more job placements during the previous 12 months with an Employer, they shall be entitled to receive 85% of the Fee posted by that Employer which shall apply as of the third successful placement.

Sample Transactions:
Anne Williams of W Associates fills a Regulatory Affairs Manager for EDAC Pharma with a base salary
of € 60,000 / annum and a fee of 25% of salary.

Payment Schedule * Fee % of Fee
EDAC pays Candex: €15,000 100%
If Anne is an existing supplier:
Candex pays Anne: €14,550 97%
Candex keeps: €450 3%
If Anne is not an existing supplier:
Candex pays Anne: €11,250 75%
Candex keeps: €3,750 25%
If Anne fills repeatedly with EDAC: **
Candex pays Anne: €12,750 85%
Candex keeps: €2,250 15%
* Funds will be dispersed in the same currency as the placement fee paid to Candex. Depending on location of Supplier's bank account, additional transaction charges may apply.

** This case assumes Anne is not an Existing Supplier.

Payment Terms:
After a successful placement, Employer is invoiced by Candex on the candidate start date. For Existing and Referred Suppliers, we will make payment within 3 business days of receiving funds from Employer and Employer has total flexibility in setting their own payment terms. For Marketplace Suppliers, we will make payment 60 days after the Start Date assuming funds have been received from the Employer and Employer owes money in 30 days from Start Date.

Customizable Employer Terms:
Each Employer may vary specific parts of their contract for recruitment services by geography and even by Supplier. Details on the contract terms that apply to a particular assignment can be found on each job. Each Supplier must agree to these terms with each candidate that they submit. Below is an example of employer terms that may be displayed.
